Enquanto os direitos civis impedem a intromissão do
poder político na esfera individual, também chamados
de direitos da liberdade legislativa ou apenas liberdades
negativas, os direitos sociais, ao contrário dos direitos civis,
obrigam o Estado a intervir na esfera individual para
satisfazer uma necessidade da pessoa. São, portanto,
chamados também de direitos de liberdade positiva ou
simplesmente liberdades positivas. Do ponto de vista técnico-
jurídico, as liberdades positivas são assimiladas ao direito
de crédito qualquer que seja a posição subjetiva que
garante a execução de uma prestação. O direito à saúde
tem uma característica seja da liberdade negativa, seja da
liberdade positiva: o indivíduo pretende, de uma parte,
que todos deixem de afetar o seu bem-estar psíquico,
físico e social, e de outra que os poderes públicos ofereçam
a ele os serviços para a obtenção deste bem-estar. O
balanço dos princípios de liberdade e solidariedade pode
influenciar de maneira relevante o conteúdo, negativo e
positivo, do direito à saúde.

While civil rights prevent the intrusion of political power
into the individual sphere, social rights, also called legislative
rights of freedom or negative liberties, unlike civil
rights, force the state to intervene at the individual level
to meet the needs of the person. They are therefore
also called positive rights to freedom or simply positive
freedoms. a technical and legal standpoint, positive
freedoms are assimilated to the right to claim whichever
is the subjective position that ensures the implementation
of the provision. The right to health has characteristics of
both negative freedom as well as positive freedom: the
individual looks, in part, for all to fail to affect their physical,
social and mental well-being, and, on the other hand,
for public authorities to provide the services to obtain
well-being. The balance of the principles of freedom and
solidarity in a relevant manner can influence the content,
negative and positive, of the right to health.
